Hi, all:
I have a few questions regarding changing job, if anyone knows it , please reply to me. My current situation is:
(1). I-485 was sumitted on 07/2007 and it is still pending. EB3 category.
(2). EAD card valid until 10/2012.
(3). H1-B visa valid until 03/2012 through my current employer.
I find another job which similar to what I-140 describes. But this new employer is a job agency and unwilling to tranfer my H1-B visa. It wants me to work on my EAD card on 1099 form.
So, my questions are:
(1). Will it be problem if I work as independent contractor on 1099 form not W2 form?
(2). Is there any problem to new my EAD card since I lost my H1-B visa?
(3). Do I need to inform INS about this job changing? If so, what docuements I need to submit?
(4). What if my current employer revoke my I - 140, does that mean my GC will be denied? what should I do if I want to keep legal?

USCIS are doing internal transfer from more than a year(140 & 485). They are processing 140 and 485 at both the centers and requesting the application at NE only. It seems now you noticed.
I looked at both the service center webpages(texas & nebraska) & I-485 application has to be sent to Nebraska only.I do not understand now why they are transferring the application from nebraska to Texas
if I-140 is approved at Texas.
Has anyone have any idea?

As far as I can remember all I needed for SIN card was my landing papers and my passport as ID. I did not open a bank account in Canada so I can't help you with that one.
Is there an advantage in opening a bank account if you plan to return to the US? Please let me know. I might want to open one myslef if it's going to help in anyway.

can we file a lawsuit against USCIS for not following their own guidelines and "discriminating " against cases ?
All cases should be treated equally... don't care whether they are low hanging fruit or not... every case should be represented equally before an IO...
I dont understand why should hard to determine cases be penalized for USCIS's laziness throughout the year and then trying to speed up the process in the last two months...

If USCIS continues to under perform, as they have been doing always till now (reason why EB3 ROW has moved substantially), then EB3 India will temporarily move forward this July.
My gut feeling is that it may move to end of 2005, this is to enable DOS utilize as many VISA numbers as possible during the last quarter of the FY before the unused numbers goes down the drain.
This is what Ron Gotcher also has specified.

Mehul, After reading your post, I feel very bad for what you are going through and my heart goes out to you and your family. I know nothing of what I say is enough to help you but again, I still say it with the hope that things will turn around for you. GOD HAS HIS WAYS, AND HE IS THE ULTIMATE FORCE IN THIS WORLD. I have often wondered, the chase we chase. The reality is nothing else matters but HIM yet it is so difficult to accept this reality and we chase the materialistic things in him which at the end, every one of us writing here and reading is going to leave behind one day.

The problem will come, if you have an RFE for employment. If you get a letter from client, they will say that the company has employed, say for example Mr John as a Programmer Analyst for a period of 1 year. This will open up one major issue, that is you do not work for a company. The H1 and 485 is an application that is sponsored by a company, there is no clause for self sponsor. So when they see u are self sponsored, they could reject your 485.

I am pretty for EB3 folks. This is really not fare to those genuine guys (not substitute ones) waiting more than 7 years. I am know few friends applied with me in EB3 have lost green card hope. They are eligible for EB2 when applying but only reason that stopped them is their company don't want them to apply in EB2 category. Praying god is the only thing I can do for them..

I think it is about time for IV to think and make $25/month minimum fee for accessing this site. IV needs money to lobby to sort GC mess out. At the same time we need serious people ready to volunteer and donate. That is the only way out. We do not need people discussing SRK and Vonage on this site. We might reduce website hits by doing this but at least we will have ust have serious members who actually want to volunteer and work for IV.

Like my title says - Could it be a mistake on their part for EB3 I ? Was it meant to be 15th April 2002 ?
In March of This year it was 15th Oct 2001. Then it goes to U for untli Oct and now its 15th April 2001 (gone back 6 months !!!!) This seems odd for a new fiscal year with new Visa Quota however small EB3I may be - are there still that many 2000-2001 applications pre-adjudicated in the system waiting for a visa that they had to roll it back ?

Legal immigration has had a positive impact on the United States and our economy. Our porous borders have allowed more than ten million people to cross into our country with no oversight, no accountability, and no record. We simply have no idea who they are, where they came from, and most importantly - why they entered our country illegally. I believe we must increase the size of the Border Patrol to 18,000 agents, we must actively construct a double barrier wall and utilize technological innovations, such as unmanned aerial vehicles, to conduct surveillance operations along the remaining border.
Once we have secured our borders, we must turn our attention to the more than 12 million illegal immigrants already residing here. There are varying proposals currently being debated here in Washington as to what is the most economically feasible approach to addressing this situation. I do not support amnesty for those individuals who have broken our laws and will work to deport those individuals who have become a financial and social burden on our society. I believe that we must establish an Employer Verification System that is easy to use and provides timely feedback to employers. Any employer that continues to knowingly employ illegal aliens should be assessed heavy fines and penalties.

IV could not even collect 20K in the Washington DC drive. I hardly saw EB3 folks contributing. If every EB3 person contributes 50USD, it will be enough to run a campaign. Action is the key, not posting in forums.
Pl don't make blanket statements such as this. BTW, I contributed to DC advocacy and many other EB3s also did the same.
Fixing the language so that folks do not take it personally.
