I resonate the feelings of all on this forum, God bless you and your family, these are some thoughts coming to my mind... all might not be feasible in your case so take what you think might help the current situation and make an informed decision.
- Find an "good" immigration lawyer, most immigration lawyers are very community minded, they might also help you without any fees,
- There is a huge fiji community in US I am talking about well established business people (especially in automobile industry) who can help in applying a H1 visa for your wife as a backup and also meet local politicians, and take an infopass appointment to know what really happens to such cases like yours.
- Since you are a Indian Citizen you can go to India for a second opinion if you prefer to, there are great Doctors who studied in US and went back to start their own clinics. Canada is another country who gives free health care and have a shorter immigration process.
- Life in India will also be less expensive if you decide you live there with your savings of 8 years, you might want to look into India's policy on Fiji citizen immigration if your wife/children are Fiji citizens.
- I am sure you must have looked into cancer survivor stories, stem cell research and treatment options.
- Last but not least, concentrate on getting better - fight back, also look into your life insurance options, property papers and write a Will.
God Bless you from what i can understand you are a fighter dealing with health issues, Fiji immigration issues and US immigration issues I am sure you will post a message here at a later date that how you survived and this whole thing will be just a bad episode in your life which came and went away.

There is a 99% chance of a TV crew covering this event. I just spoke with them and they are just working out the logistics. They will reach the USCIS office at around 12 PM and said that it would be great if some of us are available around that time to talk to them.

I recived the case nos from TSC , they had received mine & my wife's applications ( 485, 765,131 ) on 4th June , I see one set of checks cashed.
I expect the other set to be cleared some time Mon-Tues

None of this damn crap is fair. There are 3 lines in the green card queue. 1) Labor/PERM line, further subdivided on the basis of BEC, PERM, Employer willingness, exempt(NIW) etc. 2) the I-140 Line and 3) the I-485 line. These lines each have inconsistent patterns depending upon the winds of the day, a few years ago, LC/BEC lines were long, employers were less willing to sponsor green cards, and there was no I-140 PP processing, now all of a sudden PERM is there, PP of 140 came into being, and 485 became an eternal wait and country quotas came into being. For those that got screwed with BECs then PP 140 got removed when they were ready to file and now PD retrogressed into the stone age, it sure would seem like non sense for the guy who got PERM in 2 weeks, then PP 140 in 10 days and filed 485 in he July fiasco. Nevertheless you are only speaking in terms of degrees of getting screwed, since all are being done so by an unpredictable and unreliable system.

A wait of 2yrs, 5yrs or 10 yrs is immaterial, all of the above are ridiculous in EB immigration, degrees of unfairness is splitting hairs if you ask me. If you want to play chess you got to play it by the rules. If you think you can win the game if we can change the rules, I would say it is not impossible but a long shot.
In USA every citizen is supposed to follow the law that is the fundamental reason why this place has been attracting so many immigrants ( anybody can pursue their dreams if they follow the law). If you think govt officials are above that you are wrong, if you encourage that by accepting it, that will not make this place any better than other third world democracies. All govt officials in the USA are accountable for what they are entrusted with, if you didn't know about it until now there is something wrong with the system we are working with. I can say this with full authority on this matter because I work for the goverment.
Let us give it a little though and see if fighting to make the dept follow the law is worth while. If we think it is not, getting a GC and living here is not any better than living back home.

For me country cap was an important issue, so I started a focus group. If you think filing I-1485 is more important than start a focus group, you may find 100s who will support you...you can start a yahoo group

If there is no bill flying now and situation is tough, then you are attracting too much attention when everyone is against immigrants. God forbid they decide to punish immigrants more due to this by more anti-bills.
You would be safe because you have EAD. But what about those without EADs.
If you really want to do something then help us allow filing I485 when visa dates are not current. So that everyone gets EAD. EAD is lot better than H1B and this will be a temporary relief. EAD gives so much protection than H1B and that should be our #1 priority.

I heard in yesterday radio talk show (with PA congressman) that a new group formed by house representatives (congressmen) called "representatives for legal immigration" (exact name not known because they said they are constructing a new website too), looks like, they oppose the illegal and support legal immigration. nt sure whether they will be of any help atleast during STRIVE bill debate to bring some relief to EB.

Can we setup a separate payment account for those willing to contribute to this campaign? It becomes difficult to coordinate if every individual goes on to mail the flowers. Instead we should all contribute to the "send a flower" campaign and then the person in charge of the account should send those flowers (with the note) on a pre-selected date.
It makes things easier for people and they may be more willing to participate!

Do you know who received it at Nebraska Center? You will find the name of the person who received it in FedEx/DHL/UPS delivery confirmation based on the tracking no. you provide while checking status. Was it M. Schwitzer?
Me and two more of my friends sent our respective petitions on July 27th at the same time thru the same lawyer. All these petitions were received in separate FedEx packets by this guy M. Schwitzer on 30th July. All of us are on the same boat..... no receipt notices, no encashed checks...
My applications ( I-140; I-485; I-765) were mailed on July 27th to NSC and they had acknowledged received on JULY-30th as per the mail delivery confirmation.
Today I recieved a note from my lawyer that the receipt notice has been issued for all of my applications.
Phew that was a relief as I was about to leave to India soon and was worried about travelling without the receipt number.

I think taking second/third opinion is going to help and as far as your wife Immigiration case .. I think some members mentioned about talking to Attorney .. You can also drop a email to Sheila Mutrhy and Rajive Khanna. I am sure they will come out and help...

For all those who are waiting...I would suggest one more thing, if your file is not touched. My lawyer had sent an email to NSC on Aug 2. I believe that along with my SR might have done the trick.....Sheela Murthy was my lawyer....that too might have helped....Who know what works....but we can all try.....Hope all who are stuck, get their GC by end of this month.
