    And what criteria are they following?

    I had taken infopass and officer sent an email to TSC enquiring about current status. Today, I got snail mail reply..

    "Due to the high volume of expedite requests for this case type, we are strictly enforcing the criteria that has been set for these expedite requests."

    if the only way to reduce the backlog of EB3 is to port to EB2, why EB3 category at all. Just remove that category... Maybe lawyer's should come with a better alternative than giving this lame advice. EB3 category are still employed for the past 10 yrs - shows that they are required-then why not fight to get their number of visas increased or the spill over be applied to them equally as to EB2.

    Apahilaj,

    I got the SR response letter saying I contacted them and they are responding by saying that I should wait for the FP if I have not received one yet. So basically I am where I was 2 months ago.

    If you read my earlier posts, I did have doubts that FP and NC may have some connection together.

    But I think this seems more of a glitch in the TSC system in generation of FP. I mean either its NC or glitch that is causing this delay. Anyway, the NSC at least generates one for you after you speak to an IO. We are unfortunate in that also.

    In your response letter, did they anywhere mention about biometrics or finger printing notice specifically? In my letter, they did not mention about finger printing at all...All they said that the decision on my case has been delayed due to ongoing background check...I am not sure if they even knew that I had opened up the SR for not receiving FP notice.

    Yeah, I was thinking about your earlier post last night when I was reading the response letter..:) But I just can not subscribe to the idea that FP and name checks are even remotely connected...

    Well, we just have to wait and watch...good luck to all the fellow sufferrers..

    Wonder if you happened to mention the time line question? One section in the "Guest Worker" chapter says it can not be implemented 90s before the study, would that only cover the "Guest Worker" section or the whole bill? The house will try their best to push an enforcement first approach, if they gain more on that, then we might end up with a bill passed but never take effect. That would be the worst situation.

    Today I spoke to a Representative who deals with immigration issue at Sen Mike Dewine's (R-OH) office. I spoke to him for 15 minutes to understand what he and his senator think about this CIR.

    Here is he and his senator feels about this bill. It is difficult for him to say that when CIR bill will be introduced in senate floor . It depend on Majority and Minority leaders to decide. Majority leader told to the media that he will introduce before the end of the may, he is mostly consistent, but there are several bills where he has committed a timeline and till today it is not on the floor.
    However he told that once CIR pass, legal immigration is already taken care of, but if it does not passes there are bills like SKIL which will be put before the floor. But CIR has to fail or pass before you see this SKILL bill on the floor.

    thanks, but i believe this is incorrect. Per the 2005 Aytes memo (http://www.peludcarson.com/2007/01/aytes_memo_on_a.html) it is clearly stated that person can change jobs after 180 days irrespective of whether I-140 is approved or not. The key phrase is that I-140 should've been "approvable when filed".

    So what? I-140 was "approvable" but now employer revokes it and therefore 485 denial becuase 180 days have not been passed. And that is why one never should even try to use AC21 before 180 days period. Even I-140 is already approved, revocation of it will initiate 485 denial.

    Only if it is too restrictive. this case is pretty straightforward and simple. employee is directly hitting the employer's revenues.

    That means nothing in the court actually. It takes a lot more such as violation of trade-secrets for a court to rule against an employee. If hitting revenue was a valid reason not to change a job, nobody will ever be able to change a job.

    What you mention is a common misconception.

    I think we got our green cards.

    Current Status: Notice mailed welcoming the new permanent resident.

    On August 12, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service.


    Only catch for us is that we are moving next weekend!! I am going to do change of address with USCIS immediately, but in the meanwhile what if they mail documents to my old address? Any suggestions?

    Also whats ADIT.

    BTW our case was at NSC and priority date is May 2004. Application mailed Aug7th 2007.

    FYI sent wife's application on August 11th .. reached NSC on 14th .. checks got chshed yesterday. Online status says application was picked on Sep 25th.

    My application was sent on 2nd July reached July 3rd and have received recepit noice earlier.

    Is it going to hurt if we wait for some more time.It is not that we are missing getting our green cards and our priority dates are current. I have also got my case transferred from NSC-->CSC--> TSC. I agree that stuttling the paper work around the country is an extremely inefficient way to conduct business, but that is what CIS is. I got my transfer notice on the October 5th. I guess they will need more time to get my paper work and schedule an FP appointment.

    I have donated in past a few hundred - stopped now. I think major portion of donated money goes to a Lobbying firm and I think it is a mere wash. The fact they couldn't facilitate even a single bill in House or Senate for visa is a testament of their failure. Whatever IV has achieved so far ..like July visa bulletin (Flower compaign, coordination with AILA and congresswoman Joe Lofgren) and admin efforts for 2-year are purely the result of IV core and member active participation. Correct me if I am wrong.

    I would start donating again if IV stops spending on a lobbying firm and starts spending on highlighting our plight with American Media.

    Guys:

    For all those who are waiting...I would suggest one more thing, if your file is not touched. My lawyer had sent an email to NSC on Aug 2. I believe that along with my SR might have done the trick.....Sheela Murthy was my lawyer....that too might have helped....Who know what works....but we can all try.....Hope all who are stuck, get their GC by end of this month.

    I suspect you are right. Even my lawyer kept the memo ready sent it out on Aug 01 requesting a FP notice and instead i get a "card production" email. The lawyer had indicated that these memo do result in case movement and not many take advantage of the possibility.

    The issue is not with desi consultants. It is with those companies who game the system and take advantage of workers from India. If you believe that the petition filed by your company is legit, then it is all good - you will never have to worry about any audit or RFE.

    As I have said before, the problem arises when some companies file petitions when there isn't an immediate job offer. They often take money from the H-1B worker to file the petition and not pay them when they are on bench - making them vulnerable to USCIS audits. In my view this is bad for the H-1B program and everybody who is involed, and it should be investigated by the USCIS.

    Now, there may not be many who do this - but a few bad apples have certainly given the rest of us a bad name.
