    Guys wake up and fight to make the porting rules very strong if not stop porting. The rule should be if I140 for porting is denied then the applicant should loose his/her initial EB3 priority date also as he /she has indicated that he/she is no longer working in the position as described in EB3 labor. This will make sure that fraudulent applicants cannot port from EB3 to EB2.

    There are many genuine cases, who could have applied in EB2, but due to some erroneous counsel by employer or legal, ended up in EB3 category. Having an option to port PD when applying under alternate category is available, and people eligible taking advantage of this should be allowed to do it and encouraged. Given the market condition, if some one could qualify under EB2 and successfully secure a EB2 labor/I-140, then it must be welcomed and only genuine cases could do so. People with EB3 PD of 2001 or 2002 and waiting for GC might already have worked one or two years prior to starting the process and might be in country working for almost a decade and some even have done their Masters and have the experience. With all this, if they take advantage of this, then they deserve it. I am not able to understand your concern, and also expecting/requesting the porting process to be stopped !! Does not sound right.

    From all the options we have at hand immediately, I suggest the following to be the quickest and most effective

    Chant the mantra "Man Yo Ho Rehna Kyo"
    This should be done as many times as possible for 2 weeks
    Avoid chanting from 12:00-3:00
    Keep in mind the person who you think is the obstacle on your path while chanting

    It worked for someone I know. It worked for me. And now to make it work for all of us we all have to chant. Remember, just 2 weeks!

    Make it to 2.5K instead of 5K. By the speed we are in right now, I don't think we will reach your destination so early. But contribution is being very slow. Sorry for being -ve.

    Had this been a call to build some temple or religious place I bet we would had been collected 5 - 10 times more than what we are at now.

    I took the example here from a temple collection in my area, which when planned to upgrade it's kitchen, collected more than 175K in 15 days.

    My PD of Dec. 2004, I think it will be late 2010 before I see my date current. I hope we atleast see May 2007 visa bulletin dates in May 2008.

    dummgelauft porting is happening and you may be correct about non IT companies and big IT companies being unwilling to port.
    I can recollect 7 people immediately of which 1 is a genuine EB2 , 1 was a genuine Eb3 (2003) and remaining 3 have done labor substitution in Eb3 , 2 in Eb2 with dates ranging from 2002-2004 during the July Fiasco. 2 Eb2 people already got their GC's.

    The other 3 people now have at least 3 years exp from 2007 --> 2010. Making them eligible for Eb2 ( with a variety of education + work exp combinations).

    Lucky people are the ones, who could manage to get labor substitution during June-July 2007, got EAD's within 6 months, had the flexibility these 3 years and are now capable of porting to Eb2.

    In the end it boils down to how resourceful one is and adapts to the situation and able to make things better for themselves. Same goes for L1 -> EB1 route. Porting by a person who has a substitute labor of 2002 ( in July 2007) will also effect a genuine EB3 application from 2006, as they are moving ahead even in the Eb3 queue.

    Porting is here to stay , the only hope for people is to combine efforts and try to follow up on the various proposals ( STEM Exemption, visa recapture, counting dependents in family quota, and provide relief to people by at least letting them file 485's without waiting for dates to become current )

    Yes, I am here for around 12 years with no GC and I won't mind if someone interviews me to cover my story, also will submit my story in 'tell your story' thread.Today, I have signed myself in Ohio chapter to meet like-minded souls...

    I have some problem on surfing & responding back because our "Big Brother" wathces who is surfing for how much time and also he/administrator did blocked Yahoo/Hotmail & all mail related to website..thats usual story for "Consultant Contractors"...

    pls submit your story in 'tell your story' thread if you are interested in being interviewd. we need many compelling stories for media all the time.

    currently we have an opportunity with a very high profile magazine that wants to do a story. We have been unable to find the right story as per the reporter's need in that thread. ONly a few members have added their story. Pls add your story asap

    Hi Maag,

    I did not land yet. Planning to give away canada PR. Its too much of risk being on AP/EAD. I have too many things on stake in US like Home, Nice Jobs for me and my wife..don't want to risk all that.

    As it is i don't think I will ever settle in Canada, i had applied at a time when my US labor was stuck in backlog for almost 5 years but now things have changed and if i ever have to leave US I think I will go back to my home country; as it is after being here for 8 years I don't have energy to start all over again in some new country.

    What have you decided? do you know the procedure to get landing fee back?

    I am also giving up canada PR, i had also applied at the time my green card process was not moving, also i don't have any job offer as of now in canada, i don't want to leave what's in hand in hope of something similar (can't say better). I don't know procedure to get landing fees back and will soon be working on that.

    Few days ago, I saw this on TV - An American soldier died in Iraq leaving behind a 29 year old Polish wife and 6-month-old US citizen baby. Wife's paper (adjustment of status from K1->GC) was pending for 6 months or so with USCIS. When USCIS came to know about the death of that soldier (US citizen and I do not know how they came to know about it), they issued deportation order for his wife. Reason being, primary applicant is no more in this world so his dependent's application is null and void. She has been running from door to door with a baby in one arm and death letter of her husband with deportation order in the other arm. There is no one to listen to her. She lost her husband; she is going to lose her house and ability to stay in this country.

    I absolutely hate to say this but Mehul, I think your wife will be better off in her home country. Please weight this option as well. My prayers are with you.

    I totally agree on EB3 to EB2 porting but the PD should be the day he qualified as EB2 not the original date of EB3 which makes sense.

    This way everyone is happy.

    People who have done Masters (EB2) should get the GCs first. :) ...Relax dont give me a red for this. I already had enough.

    Hi All
    I will ask you in a specific manner .Will you guys help me?

    1. Till now I worked on contract as a SAP Consultant with BIG 4 companies and piled up a lot of responsbilities. I got my EAD and one of the BIG wants me to join as Associate Partner- SAP. Can I accept it on EAD?

    2.Till now my salary is USD 65,000+Bonus.With bonus my salary is in the range of 120K -140K. But now the BIG 5 offers me a salary in the range of USD 180K -200K.
    Can I accept the 'offer' based on the above points and use my EAD?
    Or is it a violation of AOS rules?
    Appreciate if you throw light on this specific case

    I have read in a few places that we plan to send flowers on 11, and 12th also?

    If that is the case then the document has to be updated to include those dates. Also, I suggest collecting emails and fax numbers and assigning a few people to do the actual "sending". This will make it easier to coordinate.

    11th and 12th were added later because by Saturday evening when the core team decided to support this campaign, we weren't entirely sure if delivery on the 10th was still possible.

    However, majority of flowers are going to be delivered on the 10th so I wanted to keep the focus on that single date.

    If you want to go ahead with co-ordinating the actual sending then please go ahead - I think it will be very helpful.

    And worst is the lottery...

    And I know a guy (a restaurant waiter from Nepal) got his GC in frikkin 14 months. And this was 5 years ago when I had just applied and now even today mine is still pending and that Nepali waiter who could not speak 4 words in English is now a Citizen and whenever I go to this restaurant for a buffet he keeps laughing at me and he is still a waiter in the same restaurant. I know him for 6 years. I get enraged at this countrys immigration policy. And I have met about 5 cabbies (Somalia, Pakistan, Sudan) etc etc who came here by winning visa lottery. And they are all citizens or GC holders. This is a mockery. This country has finally started to SUCK big time.

    I am still waiting?

    I called USCIS today morning, response was by end of this (oct)month they will complete all data entry for I-485. He told that last week they did lot of entries for July 2 and we should see the receipt number any time soon.
